add Switzerland to the country detection engine

You now support the new Swiss Data Privacy Law - thanks for that.

Can you please add Switzerland to country detection engine? The background is quite simple: in the Swiss Data Privacy Law there’s no legal requirement to use a Cookie banner. But when a Swiss company acts in in the EU (which happens quite often), then they have to also abide to the GDPR; i.e. no Cookie banner for requests from Switzerland, Cookie banners for all requests from outside Switzerland.

Adding the ‘no cookie-thing’ would make the difference to your competition.
Thanks in advance

  • The Swiss Data Privacy Law (LPD) is a data protection law that applies to all personal data processed in Switzerland. The law does not require the use of a cookie banner, but it does require companies to obtain consent from individuals before collecting or using their personal data.

The General Data Protection Regulation (GDPR) is a data protection law that applies to all companies that process the personal data of individuals in the European Union. The GDPR requires companies to obtain consent from individuals before collecting or using their personal data, and it also requires companies to provide individuals with certain rights over their personal data.

By adding Switzerland to the country detection engine, you will be able to determine whether a visitor is from Switzerland or not. This will allow you to show or hide the cookie banner accordingly.

  • Hi Amir,

that's not fully correct! With the new Swiss Data Privacy law there's no consent required when collecting personal data from Individuals (except for some limited situations).

The background: one of the major differences between the EU GDPR and the Swiss DSG is: while with the GDPR processing of personal data is forbidden (except explicitly allowed), the new Swiss law works vice versa: it allows data collection except it's explicitly forbidden. And this applies to all kinds of data collection methods (applications, contact forms on a website or trackers like Google Analytics).

  • Integrating Switzerland into the country detection engine raises questions about its legality. Ensuring compliance with data privacy and international laws is crucial when expanding such systems.

  • The inclusion of Switzerland in the country detection engine creates legal concerns. When extending such systems, it is critical to ensure compliance with data privacy and international regulations.

  • @austinchase, @wishraw

there are no legal concerns at all. The new Swiss Data Privacy Law allows tracking without consent. However, to support those Swiss data subjects which don't want to be tracked, I've defined the following default rules dependent on a per customer basis:

    • when there are tracking cookies (like Google Analytics, etc.), country detection is disabled and a cookie banner pops up worldwide
    • when there are no tracking cookies, country detection is enabled for Switzerland but a cookie banner pops up for the rest of the world.
    Hope this helps.
    Bernd
